Biden Decides Not to Enforce TikTok Ban, Handing the Controversy to Trump’s Incoming Administration

WASHINGTON D.C. — As the TikTok ban hovers just days away, the platform is flooded with emotional farewells and hopeful messages from creators across the United States. Scrolling through the app feels like an endless stream of heartfelt posts, with creators thanking their fans for their support and reminiscing about their journeys. Many are keeping their fingers crossed that this isn't the end of the line, but the uncertainty has cast a somber mood over what is normally a hub of creativity and joy.


"I just want to say thank you to everyone who’s been a part of this journey," one creator shared, echoing sentiments seen in countless other videos. "Hopefully, this isn’t goodbye, but if it is, it’s been amazing."


The looming ban on TikTok in the United States is sparking high-stakes legal and political maneuvering as the January 19 deadline approaches. President Biden and President-elect Trump face limited but significant options to either enforce, delay, or creatively circumvent the ban mandated by the Protecting Americans from Foreign Adversary Controlled Applications Act.


The Biden administration announced Thursday it will not impose fines on U.S. companies that continue supporting TikTok after the ban takes effect, effectively running out the clock before President Trump’s inauguration on January 20. This decision, while buying some time, leaves the app’s future squarely in the hands of the Supreme Court and the incoming administration.


Supreme Court Options and Their Implications

The Supreme Court holds a pivotal role in determining TikTok's fate. The justices have four potential courses of action:

  1. Declare the TikTok Ban Unconstitutional: Such a ruling would render the law void, allowing TikTok to continue operations without further intervention. This is the simplest outcome for users and the company.

  2. Issue an Administrative Stay or Injunction: A temporary pause would give the court more time to assess the case while delaying the ban's implementation.

  3. Deem the Ban Constitutional: Upholding the law would enforce the ban, compelling immediate compliance.

  4. Take No Action: By default, this would allow the ban to proceed as scheduled.

Legal experts note that the second and third scenarios would likely prompt renewed action from the executive branch and Congress to address the app's future.


Presidential Escape Hatch in the Law

The Protecting Americans from Foreign Adversary Controlled Applications Act includes a provision granting the president authority to approve a "qualified divestiture," wherein TikTok’s U.S. operations are sold to an American entity. This clause gives the president significant discretion in determining whether a sale satisfies national security concerns. Biden could have used this power to grant a one-time 90-day extension for divestiture negotiations but chose not to, citing a lack of progress toward a sale.


President-elect Trump, however, could revisit this option after taking office. If he deems TikTok’s existing security measures, such as Project Texas; a system that stores U.S. user data on Oracle servers in Texas—sufficient, he could approve them as meeting national security thresholds. Alternatively, Trump could push for a complete divestiture to a U.S.-based company, although such a sale would face complications. China has already signaled it will not allow the transfer of TikTok’s proprietary algorithm, a key component of the platform’s functionality.


Congressional Role and Biden’s Legal Gamble

If the Supreme Court issues a stay, Congress could use the opportunity to amend or repeal the law. Momentum is growing among lawmakers to address concerns about the ban’s broad implications and potential economic fallout.


President Biden’s decision not to enforce the ban’s penalties is a calculated legal gamble. Critics question the precedent set by declining to uphold a law passed with bipartisan support. Meanwhile, tech companies and app stores face uncertainty over whether to continue hosting TikTok, given the risk of fines if enforcement resumes.


Next Steps for the Trump Administration

Trump’s options include redefining what constitutes compliance with the law or instructing the Department of Justice not to enforce the ban, a move that could face legal challenges. Another potential scenario involves negotiations for a sale, though such efforts would need to address the unresolved issue of the algorithm transfer.


TikTok’s future now hinges on the Supreme Court’s ruling and subsequent decisions by the incoming administration. "This is a critical moment for both the app and broader questions of digital sovereignty," said a legal analyst closely following the case. "What happens in the next 72 hours could set precedents for years to come."
